The necessity of trademarks

A trademark is necessary to have the exclusive right of using a distinctive sign on the market so that the consumer can easily distinguish a commercial activity from that of competitors.

Industrialization and the possibility of delivering goods over considerable distances has created the necessity to individualize products in all industrial branches.

In the past, products were interchangeable and usually satisfied the needs of a specific local or regional market. Also, most of the products were unique in design, as production in series did not exist. With the possibility to produce large quantities of the same product in a constant quality, the need arose to identify the product, and with it, the expectations and confidence that the consumer associates with this product. The producers then started to invest money in the research and development of a product. They realized how important it is to prevent their products from being copied or confused with others.
